These general conditions of sale ("General conditions") are governed by the Consumer Code (Legislative Decree no. 206/2005), section II Distance contracts (articles 50 - 67) and by the rules on electronic commerce (Legislative Decree no. 70/2003).

1) General conditions

The Customer is invited to print or keep the General Conditions according to the preferred methods.

In the event of changes to the General Conditions, the General Conditions published on the Site at the time the order is sent by the Customer will apply to the order.

2) Offer to the public

The products and related prices presented on the Site constitute an offer to the public in accordance with the methods specified in the General Conditions and on the Site itself. The conditions of this offer apply exclusively to purchases made on the Site.

The purchase contracts stipulated on the Site are concluded with ABACO PHARMA.

3) Prices

All prices include VAT and delivery costs are highlighted at the time of the order.

The price shown on the Site at the time of the conclusion of the order is applied to the products, without any consideration of any price changes that have occurred subsequently or previously offered.

4) Order

The Customer successfully completes the order procedure if the Site does not show any error messages.

The contract is concluded upon receipt of the order by ABACO PHARMA. In this case, ABACO PHARMA will acknowledge receipt of the order by sending an order confirmation email to the email address supplied by the Customer. This confirmation summarizes the selected items, their prices (including delivery costs), the delivery address, the "Pre-Order Number" and the general and particular conditions applicable to the order.

The Customer undertakes to verify the correctness of the data and to immediately notify ABACO PHARMA of any corrections. Possible increase in costs caused by errors in the data not reported promptly, will be charged to the Customer.

Within 3 (three) working days following the sending of the order confirmation, ABACO PHARMA will communicate the "Definitive Order Number" to the Customer. This number must be used by the Customer in any communication with ABACO PHARMA.

It is possible that occasional unavailability of the products offered may occur, in this case, if the products chosen by the Customer are not, in whole or in part, available, ABACO PHARMA will promptly notify the Customer.

5) Methods of payment

Payment can be made online by credit card in the manner specified on the Site.

At the same time as the communication of the order confirmation, the amount corresponding to the products purchased will be charged to the customer.

6) Delivery methods and costs

ABACO PHARMA delivers only to the areas specified on the Site.

ABACO PHARMA will issue an invoice for the purchased products, if requested by the customer at the time of the order or within three (3) days from the same by e-mail. For the issuance of the invoice, the information provided by the Customer prevails. No data changes will be possible after the invoice has been issued.

Delivery costs are charged to the customer and adequately highlighted in the order.

Delivery, by specialized carriers, will take place within 12 (twelve) working days following the date the order is sent, for orders whose weight is less than 30kg.

No responsibility can be attributed to ABACO PHARMA in case of delay in delivery.

Delivery will take place without an appointment and is intended at street level.

The carrier makes two attempts to deliver the products to the address indicated by the Customer. In the event that these attempts are unsuccessful, the products will remain in stock at the carrier's warehouse for 5 (five) working days at the Customer's disposal.

In case of failure to collect the products by the Customer within the period specified above, the order will be automatically canceled and the products returned to ABACO PHARMA. In this case the transport costs will not be reimbursed to the Customer.

For orders whose weight exceeds 30 kg: within 3 (three) working days following the sending of the order confirmation, ABACO PHARMA will notify the Customer of the "Definitive Order Number" and the expected week of delivery. He will then be contacted by the carrier to agree on the delivery details.

In the event that the goods are left for more than 12 calendar days at the carrier, the cost of storage will be charged to the customer.

In case of impossibility by the carrier to proceed with the delivery deriving from the customer's responsibility, the consideration for a new delivery will be charged to the customer.

Upon delivery of the products, the Customer is required to check that the packaging is intact, not damaged, nor wet or otherwise altered, even in the sealing materials (adhesive tape or metal straps).

In the event that there are obvious damage to the packaging and / or the product, the Customer may refuse delivery of the products themselves, which will be returned to ABACO PHARMA at no cost to the Customer.

Once the delivery document has been signed, the Customer will not be able to make any objection regarding the external characteristics of the products delivered.

Any problems concerning the physical integrity, correspondence or completeness of the products received must be promptly reported to ABACO PHARMA for the activation of the warranty conditions.

7) Right of withdrawal

If the Customer is a consumer, he is entitled to the rights referred to in art. 64 of the Consumer Code within the limits set by this legislation and therefore has the right to withdraw from the purchase contract for any reason, without explanation and without any penalty, in the manner specified below.

The right of withdrawal is exercised by sending - within 30 (thirty) calendar days from the date of receipt of the products - of a communication by registered letter with return receipt. addressed to:

The communication can be anticipated - within the same term - by telegram, e-mail (at info@termedisangiovanni.it) or fax (at n. 0522/514200) provided that it is confirmed by registered letter with return receipt, within the next 48 hours.

The notice of withdrawal must specify the intention to withdraw from the purchase and the product or products for which the right of withdrawal is to be exercised, attaching a copy of the relevant invoice.

The right of withdrawal may also be exercised by returning the products to a "Terme di San Giovanni" shop or to the ABACO PHARMA headquarters.

In the event that the withdrawal is exercised by means of written communication, the return of the products must take place within 30 (thirty) calendar days from the date of receipt of the same, by delivering the products to any Terme di San Giovanni shop in Italy or by sending the products to the following address:

The right of withdrawal is however subject to the following conditions:

The law applies to individual products purchased in their entirety;

The purchased product must be intact and returned in its original packaging, complete in all its parts (including packaging and ancillary documentation);

· The shipping costs for returning the product are charged to the customer;

· The shipment is under the full responsibility of the Customer.

If the right of withdrawal has been correctly exercised, ABACO PHARMA will refund the Customer the full amount already paid, within 30 (thirty) days of receipt of the notice of withdrawal. The refunded amount will be net of the costs for the delivery of the products.

If the products are returned to one of the "Terme di San Giovanni" shops, the price will be refunded at the same.

8) Guarantees

All products sold by ABACO PHARMA enjoy the legal guarantees and commercial guarantees specified on the Site from time to time.

9) Treatment of personal data

Customer data are processed by ABACO PHARMA in accordance with the provisions of the legislation on the protection of personal data, as specified in the information provided in the "Privacy" section.

10) Communications

Any communication can be addressed to ABACO PHARMA, at the addresses indicated above.

11) Jurisdiction

Any disputes will be resolved before the competent judicial authority based on the applicable legislation.
